# \[4] 3 - Insurance Fraud

**Offense Classification: Misdemeanor / Felony&#x20;*****(Depending on severity and financial impact)***

**Definition:**

Insurance Fraud occurs when an individual **intentionally submits false claims, exaggerates damages, or fabricates incidents** to receive financial compensation from an insurance provider.

**Elements of the Crime:**

* The suspect **intentionally misrepresented facts** to an insurance company.
* The false claim resulted in **financial loss to the insurer**.
* The act was **not justified** (e.g., not a minor reporting mistake).

**Penalties:**

* **Misdemeanor:** *(If fraud resulted in losses under $10,000.)*
  * **Jail Time:** Up to 6 months
  * **Fine:** Up to $7,500
* **Felony:** *(If fraud resulted in losses over $10,000, involved multiple victims, or was part of a repeated scheme.)*
  * **Jail Time:** 3 to 10 years
  * **Fine:** Up to $75,000
  * **Additional Consequences:** Restitution, potential ban from insurance claims
