# \[4] 7 - Racketeering (Organized Crime)

**Offense Classification: Felony**

**Definition:**

Racketeering occurs when an individual or group **operates an ongoing illegal business or criminal enterprise**, using **fraud, extortion, bribery, or coercion** to maintain power and financial gain.

**Elements of the Crime:**

* The suspect **participated in an organized criminal enterprise**.
* The enterprise was involved in **repeated illegal activities (e.g., fraud, extortion, or money laundering).**
* The acts were **coordinated for long-term financial or territorial control**.

**Penalties:**

* **Felony:**
  * **Jail Time:** 10 to 25 years
  * **Fine:** Up to $500,000
  * **Additional Consequences:** Asset forfeiture, business shutdown, mandatory restitution
