# \[4] 8 - Bribery

**Offense Classification: Felony**

**Definition:**

Bribery occurs when an individual **offers, gives, receives, or solicits something of value** to influence the actions of a public official, business representative, or organization.

**Elements of the Crime:**

* The suspect **offered, gave, or accepted money, gifts, or favors**.
* The bribe was meant to **influence an official decision or outcome**.
* The exchange was **intentional and not a lawful donation or payment**.

**Penalties:**

* **Felony:**
  * **Jail Time:** 5 to 15 years
  * **Fine:** Up to $250,000
  * **Additional Consequences:** Permanent ban from holding public office, asset forfeiture
