# \[5] 11 - Hit and Run (Injury or Death)

**Offense Classification:** **Felony**

#### **Definition:**

Hit and Run (Injury or Death) occurs when an individual **is involved in a motor vehicle collision that results in bodily injury or death to another person and willfully leaves the scene without rendering aid, contacting emergency services, or identifying themselves**. This is considered a serious criminal offense regardless of fault in the collision.

#### **Elements of the Crime:**

* The individual was **operating a motor vehicle involved in a collision**.
* The collision caused **physical injury or death** to another person.
* The individual **failed to stop at the scene**, **render aid**, or **report the incident to law enforcement**.
* The flight from the scene was **intentional and without legal justification**.

#### **Penalties:**

**Felony:**

* **Jail Time:** 3 to 10 years
* **Fine:** Up to $25,000
* **License Revocation:** 2 to 5 years

**Additional Consequences:**

* **Restitution to victims or next of kin**
* **Civil liability in wrongful injury or death claims**
* **Vehicle seizure and forensic investigation**
