# \[5] 13 - Vehicular Manslaughter

**Offense Classification:** **Felony**

#### **Definition:**

Vehicular Manslaughter occurs when an individual **unintentionally causes the death of another person as a result of reckless, negligent, or unlawful operation of a motor vehicle**. This includes fatalities resulting from DUI, speeding, aggressive driving, or blatant disregard for traffic laws. Intent to kill is not required; liability is based on the severity and unlawfulness of the driver’s conduct.

#### **Elements of the Crime:**

* The individual was **operating a motor vehicle**.
* The vehicle was operated in a **reckless, impaired, or grossly negligent manner**.
* The operation of the vehicle directly caused the **death of another person**.
* The death was **unintentional** but occurred due to the individual's unlawful driving behavior.

#### **Penalties:**

**Felony:**

* **Jail Time:** 5 to 15 years
* **Fine:** Up to $50,000
* **License Revocation:** 5 years minimum

**Additional Consequences:**

* **Restitution to the victim’s family**
* **Permanent revocation of commercial driving privileges (if applicable)**
* **Civil wrongful death liability**
* **Designation as a violent felony (if statute classifies it as such)**
