# \[5] 15 - Joyriding

**Offense Classification:** **Misdemeanor / Felony** *(Depending on circumstances, damage caused, or prior offenses)*

#### **Definition:**

Joyriding occurs when an individual **takes and operates a motor vehicle without the owner’s consent, typically for recreational or thrill-seeking purposes, and without intent to permanently deprive the owner**. While similar to unauthorized use, joyriding often involves juveniles, peer influence, or risky behavior without broader criminal goals.

#### **Elements of the Crime:**

* The individual **took and operated a motor vehicle without permission**.
* The act was **done for recreational or thrill-seeking reasons**.
* There was **no intent to steal or permanently deprive the owner**.
* The use was **unauthorized** and **without legal justification**.

#### **Penalties:**

**Misdemeanor:** *(No property damage, first-time offense)*

* **Jail Time:** Up to 90 days
* **Fine:** Up to $3,000
* **License Suspension:** Up to 6 months

**Felony:** *(Repeat offense, property damage, evasion, or reckless driving involved)*

* **Jail Time:** 6 months to 3 years
* **Fine:** Up to $10,000
* **License Suspension:** 1 to 2 years

**Additional Consequences:**

* **Restitution for damages or towing**
* **Court-mandated driving safety course**
* **Parental or guardian liability in juvenile cases**
