# \[5] 18 - Illegal Street Racing

**Offense Classification:** **Misdemeanor / Felony** *(Depending on use, impersonation, and intent)*

#### **Definition:**

Operating Emergency-Style Vehicle Without Authorization occurs when an individual **uses a vehicle equipped with lights, sirens, decals, or other markings that imitate an official emergency vehicle—such as police, fire, or EMS—without legal permission or affiliation**. This offense includes using such equipment to deceive the public, obstruct traffic, or impersonate authority.

#### **Elements of the Crime:**

* The individual was **operating or in control of a vehicle outfitted to resemble an emergency vehicle**.
* The vehicle included **unauthorized equipment**, such as lightbars, sirens, police-style paint, or insignia.
* The individual **did not have legal authorization or agency affiliation** to operate such a vehicle.
* The vehicle was used in a **public setting** or **in a way that could deceive others or influence behavior**.

#### **Penalties:**

**Misdemeanor:** *(No impersonation or malicious use involved)*

* **Jail Time:** Up to 90 days
* **Fine:** Up to $5,000
* **Vehicle Inspection or Seizure of Unauthorized Equipment**

**Felony:** *(If used to impersonate law enforcement or interfere with emergency operations)*

* **Jail Time:** 1 to 5 years
* **Fine:** Up to $15,000
* **License Suspension:** Up to 2 years

**Additional Consequences:**

* **Seizure of vehicle or equipment**
* **Permanent bar from holding any emergency service position (RP consequence)**
* **Restitution if any harm resulted from impersonation or obstruction**
