# \[5] 19 - Endangering the Public With Stunt Driving

**Offense Classification:** **Misdemeanor / Felony** *(Depending on level of risk, injury, or recurrence)*

#### **Definition:**

Endangering the Public With Stunt Driving occurs when an individual **performs reckless vehicle maneuvers—such as burnouts, donuts, drifts, or other dangerous stunts—in public areas or around bystanders, with disregard for public safety**. This offense often occurs during illegal gatherings or “takeovers” of intersections and parking lots.

#### **Elements of the Crime:**

* The individual was **operating a motor vehicle**.
* The individual **performed stunts or maneuvers** in a public area that are not typical driving actions (e.g., donuts, drifts, burnouts, jumps).
* The conduct occurred **in proximity to pedestrians, traffic, or property**.
* The actions were **intentional, unsafe, and showed disregard for others’ safety**.

#### **Penalties:**

**Misdemeanor:** *(No injuries or damage, first offense)*

* **Jail Time:** Up to 90 days
* **Fine:** Up to $5,000
* **License Suspension:** Up to 1 year

**Felony:** *(If injuries, property damage, or crowd-related risk occurred)*

* **Jail Time:** 1 to 5 years
* **Fine:** Up to $15,000
* **License Suspension:** 1 to 3 years

**Additional Consequences:**

* **Vehicle impoundment and potential forfeiture**
* **Restitution for any damage or injury**
* **Ban from participating in motor events or local car meets (RP enforcement)**
