# \[5] 20 - Blocking Emergency Vehicles

**Offense Classification:** **Misdemeanor / Felony** *(Depending on intent and whether harm or delay resulted)*

#### **Definition:**

Blocking Emergency Vehicles occurs when an individual **intentionally or negligently obstructs the path or access of emergency service vehicles**, including police, fire, and medical responders, during the course of an active response. This offense may involve stopping, parking, or refusing to yield in a way that delays or impedes emergency operations.

#### **Elements of the Crime:**

* The individual was **operating or in control of a motor vehicle or placed an object** in a way that **obstructed or delayed an emergency vehicle**.
* The vehicle or individual **failed to yield, move, or clear the way** when required by law or obvious emergency circumstance.
* The conduct was **intentional, negligent, or showed reckless disregard** for emergency access.
* An **active emergency response** was ongoing at the time of obstruction.

#### **Penalties:**

**Misdemeanor:** *(First offense, no injury or significant delay)*

* **Jail Time:** Up to 30 days
* **Fine:** Up to $2,500
* **License Suspension:** Up to 6 months

**Felony:** *(If obstruction caused injury, death, or significantly hindered emergency response)*

* **Jail Time:** 1 to 5 years
* **Fine:** Up to $15,000
* **License Suspension:** 1 to 2 years

**Additional Consequences:**

* **Restitution for delayed services or damages caused**
* **Court-ordered public service or traffic safety education**
* **Impoundment of vehicle involved in deliberate obstruction**
