# \[5] 21 - Refusal to Comply With Lawful Traffic Commands

**Offense Classification:** **Misdemeanor**

#### **Definition:**

Refusal to Comply With Lawful Traffic Commands occurs when a driver **fails or refuses to obey clear, lawful instructions issued by a law enforcement officer during a traffic stop, checkpoint, or road incident**. This includes ignoring verbal orders, signals, or gestures intended to control vehicle movement or ensure public safety.

#### **Elements of the Crime:**

* A **peace officer issued a lawful command** related to traffic control, a stop, or safety procedure.
* The individual was **operating or in control of a motor vehicle**.
* The individual **willfully failed to comply** with the instruction, direction, or signal.
* The order was **given in a lawful and non-abusive context** as part of official duty.

**Misdemeanor:**

* **Jail Time:** Up to 30 days
* **Fine:** Up to $2,000
* **License Points:** Up to 2
* **License Suspension:** Possible for repeat violations or endangerment

**Additional Consequences:**

* **Vehicle impoundment (if circumstances warrant)**
* **Escalation to obstruction charges if behavior continues or escalates**
