# \[5] 4 - Aggressive Driving

### **\[5] 4 - Aggressive Driving**

**Offense Classification:** **Misdemeanor / Felony** *(Depending on severity, intent, and outcome of the behavior)*

#### **Definition:**

Aggressive Driving occurs when a person **operates a motor vehicle with hostile, violent, or confrontational behavior that endangers others on the road**. This may include intentional tailgating, brake-checking, unsafe lane changes, blocking other drivers, or using the vehicle to intimidate or provoke.

#### **Elements of the Crime:**

* The individual was **operating a motor vehicle**.
* The driving behavior was **deliberately confrontational, threatening, or combative**.
* The individual **intended to harass, obstruct, or endanger another driver or pedestrian**.
* The conduct went **beyond simple traffic violations or negligence** and posed a safety threat.

#### **Penalties:**

**Misdemeanor:** *(No injury or property damage, isolated incident)*

* **Jail Time:** Up to 90 days
* **Fine:** Up to $3,000
* **License Suspension:** Up to 1 year

**Felony:** *(Repeat offense, or incident caused injury, fear of harm, or property damage)*

* **Jail Time:** 6 months to 5 years
* **Fine:** Up to $15,000
* **License Suspension:** 1 to 3 years

**Additional Consequences:**

* **Anger management or aggressive driving intervention course**
* **Vehicle impoundment**
* **Points added to driving record / insurance rate increase**
