# \[5] 7 - Operating a Vehicle With Stolen Plates

**Offense Classification:** **Felony**

#### **Definition:**

Operating a Vehicle With Stolen Plates occurs when an individual **knowingly drives or uses a motor vehicle bearing license plates that are reported stolen, unlawfully obtained, or registered to another vehicle** with the intent to deceive, evade identification, or commit another offense.

#### **Elements of the Crime:**

* The individual was **operating or in possession of a motor vehicle**.
* The vehicle had **license plates that were stolen or unlawfully transferred**.
* The individual **knew or reasonably should have known** the plates were stolen.
* The plates were used to **evade detection, impersonate another vehicle, or commit a criminal act**.

#### **Penalties:**

**Felony:**

* **Jail Time:** 1 to 5 years
* **Fine:** Up to $15,000
* **License Suspension:** Up to 2 years

**Additional Consequences:**

* **Vehicle impoundment and forensic examination**
* **Restitution for any damage or losses incurred through misuse**
* **Possible charges for related offenses involving deception or fraud**
