# \[6] 1 - Driving Without a Valid License

**Offense Classification:** **Misdemeanor**

#### **Definition:**

Driving Without a Valid License occurs when an individual **operates a motor vehicle on a public road without having a valid, active driver’s license issued by a recognized authority**. This includes driving with an expired, suspended, revoked, or never-issued license.

#### **Elements of the Crime:**

* The individual was **operating a motor vehicle**.
* The individual **did not possess a valid driver’s license** at the time of operation.
* The individual was **not legally exempt** from licensing requirements (e.g., under specific permits or military operation).
* The violation occurred on a **public roadway or highway**.

#### **Penalties:**

**Misdemeanor:**

* **Jail Time:** Up to 30 days
* **Fine:** Up to $2,000
* **Vehicle Impoundment:** Optional at officer discretion
* **License Hold:** Cannot obtain or renew a license for up to 90 days

**Additional Consequences:**

* **Court-mandated driving education course**
* **Repeat violations may result in increased fines and jail time**
* **May impact immigration or employment eligibility** in some RP cases
