# \[6] 2 - Speeding (Under 30 MPH Over Limit)

**Offense Classification:** **Infraction / Misdemeanor** *(Based on severity or recurrence)*

#### **Definition:**

Speeding occurs when an individual **drives a motor vehicle at a speed greater than the posted legal limit by less than 30 miles per hour**. This is considered a minor traffic violation unless accompanied by reckless or dangerous behavior.

#### **Elements of the Crime:**

* The vehicle was **operated over the posted speed limit**.
* The speed was **less than 30 MPH over** the posted limit.
* The roadway was under **legal speed enforcement jurisdiction**.
* The speed was **not justified by emergency response or exigent circumstances**.

#### **Penalties:**

**Infraction (First Offense):**

* **Fine:** $250 to $1,000
* **License Points:** 1
* **Court Appearance:** Optional unless contested

**Misdemeanor (Repeat or Enhanced Zone):**

* **Fine:** Up to $2,500
* **License Points:** 2
* **Court Appearance:** Mandatory if issued in school or construction zones
