# \[6] 20 – Failure to Yield to Emergency Vehicle

**Offense Classification:** Infraction / Misdemeanor (depending on outcome)

**Definition:**\
Failure to Yield to Emergency Vehicle occurs when a driver does not properly yield, slow, or move aside for an authorized emergency vehicle (police, fire, EMS) that is using audible sirens or visible lights, as required by traffic laws.

**Elements of the Crime:**

* The suspect was operating a motor vehicle on a public roadway.
* An authorized emergency vehicle approached with lights and/or sirens activated.
* The suspect failed to yield, pull to the side, or otherwise clear the way as required.

**Classification & Penalties:**

* **Infraction** (no accident or obstruction, driver simply failed to yield):
  * Fine: $300 to $1,000
  * Additional Consequences: 2 points on driving record
* **Misdemeanor** (failure to yield causes obstruction, accident, or endangers emergency personnel):
  * Jail Time: Up to 12 months
  * Fine: $1,500 to $3,500
  * Additional Consequences: Restitution if damages occur, license suspension for repeat offenses
