# \[6] 3 - Speeding (Excessive / 30+ MPH Over Limit)

**Offense Classification:** **Misdemeanor**

#### **Definition:**

This offense applies when a driver **exceeds the posted speed limit by 30 miles per hour or more**, posing a significant risk to public safety and often qualifying as reckless behavior depending on circumstances.

#### **Elements of the Crime:**

* The driver was **operating above the legal speed limit by 30 MPH or more**.
* The vehicle was on a **public roadway or highway**.
* The act **posed a substantial risk to others or property**.

#### **Penalties:**

**Misdemeanor:**

* **Jail Time:** Up to 30 days
* **Fine:** Up to $2,500
* **License Points:** 2–3
* **License Suspension:** Possible on second offense or in high-risk zones
