# \[6] 5 - Failure to Yield Right of Way

**Offense Classification:** Infraction

**Definition:**\
Failure to Yield Right of Way occurs when a driver does not properly yield to another vehicle, pedestrian, or emergency responder as required by traffic laws, creating a risk of collision or obstruction of safe roadway use.

**Elements of the Crime:**

* The driver approached a situation where yielding was legally required.
* The driver failed to yield to the appropriate vehicle, pedestrian, or emergency responder.
* The failure to yield created a risk or caused interference with the right of way.

**Classification & Penalties:**

* **Infraction**
  * Fine: $200 to $750
  * Additional Consequences: 1–2 points on driving record; restitution if an accident occurred
