# \[6] 7 - Tailgating / Following Too Closely

**Offense Classification:** Infraction / Misdemeanor (depending on severity)

**Definition:**\
Tailgating or Following Too Closely occurs when a driver operates a vehicle at an unsafe distance behind another vehicle, creating a risk of collision or preventing safe reaction time.

**Elements of the Crime:**

* The suspect was operating a motor vehicle.
* The suspect followed another vehicle at a distance closer than reasonable and prudent under traffic, road, and weather conditions.
* The conduct created an unreasonable risk of collision or hazard to others.

**Classification & Penalties:**

* **Infraction** (no accident or only minor traffic hazard):
  * Fine: $250 to $750
  * Additional Consequences: 1–2 points on driving record
* **Misdemeanor** (if tailgating causes an accident, injury, or shows reckless disregard):
  * Jail Time: Up to 6 months
  * Fine: $1,000 to $2,500
  * Additional Consequences: Restitution for damages; possible license suspension for repeat offenses
