# \[7] 10 - Possession of a Prohibited Weapon

**Offense Classification:** **Felony**

#### **Definition:**

Possession of a prohibited weapon occurs when an individual **knowingly possesses or transports a weapon specifically banned under law**, regardless of licensing or intent. These weapons are considered unsafe for civilian use.

#### **Prohibited Weapon Examples:**

* Silencers or suppressors
* Fully automatic firearms
* Ballistic knives
* Homemade bombs, Molotov cocktails
* Armor-piercing ammunition (in civilian settings)

#### **Elements of the Crime:**

* The individual **possessed or transported a weapon** explicitly banned by statute.
* The weapon was **not exempted for law enforcement, military, or special license holders**.
* The suspect had **no legal defense (e.g., antique, deactivated)**.

* **Jail Time:** 5 to 10 years
* **Fine:** Up to $50,000
* **Weapon Confiscation and Destruction**
