# \[7] 13 - Pointing a Firearm at Another Person (Non-Lethal)

**Offense Classification:** **Misdemeanor / Felony** *(Based on intent and context)*

#### **Definition:**

This charge applies when an individual **intentionally aims or points a firearm at another person**, **without firing**, and **without legal justification** such as self-defense.

#### **Elements of the Crime:**

* The individual **knowingly pointed a loaded or unloaded firearm** at another person.
* The action was **not in self-defense or justified by law**.
* The incident caused **fear, panic, or a public disturbance**.

#### **Penalties:**

* **Misdemeanor (No prior record or minimal threat):**
  * **Jail Time:** Up to 6 months
  * **Fine:** Up to $2,000
* **Felony (Repeat offense or severe threat):**
  * **Jail Time:** 1 to 3 years
  * **Fine:** Up to $10,000
