# \[7] 2 - Unlawful Possession of a Class 2 Weapon

**Offense Classification:** **Felony**

#### **Definition:**

This offense applies when an individual **knowingly possesses a Class 2 weapon** without legal authorization. Class 2 weapons include **submachine guns and shotguns**, which are subject to stricter regulation due to their increased lethality.

#### **Class 2 Weapon Examples:**

* Submachine guns (e.g., Uzi, MP5)
* Shotguns (pump-action, semi-automatic, or sawed-off variants)

#### **Elements of the Crime:**

* The individual **knowingly possessed** a Class 2 weapon.
* The weapon was **unregistered, illegally modified, or possessed without a valid firearms license**.
* The individual was **ineligible to possess such a weapon** due to age, felony record, or parole/probation status.

* **Jail Time:** 1 to 5 years
* **Fine:** Up to $25,000
* **Weapon Seizure:** Mandatory
