# \[7] 4 - Possession of a Firearm by a Convicted Felon

**Offense Classification:** **Felony**

#### **Definition:**

This offense applies when a **convicted felon knowingly possesses any firearm**, regardless of weapon class. Federal and local laws prohibit felons from owning or accessing firearms.

#### **Elements of the Crime:**

* The suspect has a **prior felony conviction**.
* The suspect **knowingly possessed** a firearm or ammunition.
* No legal exemption or restoration of rights was in place.

#### **Penalties:**

* **Jail Time:** 5 to 10 years
* **Fine:** Up to $50,000
* **Weapon Seizure:** Mandatory
* **Permanent Loss of Firearm Rights**
