# \[7] 6 - Discharge of a Firearm in Public

**Offense Classification:** **Felony**

#### **Definition:**

This offense occurs when an individual **fires a firearm in a public space or within city limits**, without lawful reason. This includes accidental discharges in populated areas.

#### **Elements of the Crime:**

* The individual **discharged a firearm intentionally or recklessly**.
* The incident occurred in a **public place or urban area**.
* There was **no self-defense, range use, or legal exemption**.

#### **Penalties:**

* **Jail Time:** 1 to 5 years
* **Fine:** Up to $25,000
* **Loss of Firearm Rights:** 5 years
* **Restitution:** If property or persons were harmed
