# \[7] 7 - Illegal Sale or Transfer of a Class 1 Weapon

**Offense Classification:** **Misdemeanor / Felony**

#### **Definition:**

This offense occurs when an individual **sells, gives, or transfers ownership of a Class 1 weapon** (e.g., pistols, melee weapons) **without following legal procedures or licensing requirements**.

#### **Elements of the Crime:**

* The seller **transferred a Class 1 weapon** to another person.
* The transaction was **unlicensed, undocumented, or involved a prohibited buyer**.
* The weapon was not sold through a **registered dealer or background check process**.

#### **Penalties:**

* **Misdemeanor (First Offense, Non-Felon Buyer):**
  * **Jail Time:** Up to 6 months
  * **Fine:** Up to $5,000
* **Felony (Repeat, Intentional, or to Disqualified Buyer):**
  * **Jail Time:** 1 to 3 years
  * **Fine:** Up to $15,000
  * **Weapon Seizure & Licensing Review**
