# \[7] 9 - Illegal Sale or Transfer of a Class 3 Weapon

**Offense Classification:** **Aggravated Felony**

#### **Definition:**

This offense occurs when an individual **sells, distributes, or transfers a Class 3 weapon**, such as assault rifles or explosives, **outside of legal parameters or to an unauthorized recipient**. These weapons pose significant threats to public safety and are heavily regulated.

#### **Class 3 Weapon Examples:**

* Assault rifles (e.g., AR-15, AK-47)
* Rocket-propelled grenades (RPGs), IEDs
* Military-grade explosives or launchers

#### **Elements of the Crime:**

* The suspect **knowingly sold or transferred** a Class 3 weapon.
* The weapon was **not legally registered or approved for sale**.
* The buyer was **not legally permitted to possess such weapons**.
* The transaction was conducted **without oversight or required federal/state licensing**.

#### **Penalties:**

* **Jail Time:** 10 to 20 years
* **Fine:** Up to $100,000
* **Federal Referral:** Possible based on scale of transaction
* **Permanent Ban on Firearm Possession**
* **Asset Seizure:** Profits from illegal sale may be confiscated
