# \[8] 1 - Possession of a Controlled Substance (Class A - High-Risk)

**Offense Classification:** **Felony**

#### **Definition:**

This offense applies when an individual **knowingly possesses 5 or less units** of a **Class A controlled substance** without legal justification. Class A substances carry the highest legal penalties due to their severity, addictive nature, and high potential for abuse.

#### **Examples of Class A Substances:**

* **Cocaine**
* **Methamphetamine**
* **Ecstasy (MDMA)**

#### **Elements of the Crime:**

* The individual **knowingly and unlawfully possessed** a Class A substance.
* The total amount was **under 10 units**.
* The substance was **not authorized for possession** under any legal exemption.

#### **Penalties:**

* **Jail Time:** 1 to 3 years
* **Fine:** Up to $10,000
* **Probation or Drug Diversion:** Optional (first-time offenders)
* **Asset Seizure:** Mandatory for illegal proceeds
