# \[8] 11 - Possession of Drug Paraphernalia

**Offense Classification:** **Misdemeanor**

#### **Definition:**

This offense applies when an individual possesses **tools or materials used for consuming, packaging, or distributing controlled substances**, regardless of whether drugs are present.

#### **Examples Include:**

* Pipes, bongs, syringes
* Digital scales or baggies
* Pill crushers or grinders
* Empty vials or containers with residue

#### **Penalties:**

* **Jail Time:** Up to 3 months
* **Fine:** Up to $1,000
* **Diversion Program Eligible (First-Time Offenders)**

* **\[8] 12 – Public Intoxication (Narcotics)**
* **\[3] 6 – Obstruction (if paraphernalia was concealed from officers)**
