# \[8] 12 - Public Intoxication (Narcotics)

**Offense Classification:** **Infraction / Misdemeanor**

#### **Definition:**

This offense occurs when a person is **visibly under the influence of a controlled substance** in a public place, posing a **risk to themselves or others**.

#### **Elements of the Crime:**

* The individual was **in a public space**
* The person showed **observable impairment due to narcotics**
* The person **posed a danger to themselves or the public**

#### **Penalties:**

* **Infraction (Cooperative / Minor Impairment):**
  * Fine: $500
  * Optional transport to detox
* **Misdemeanor (Resisting / Repeat / Danger):**
  * Jail Time: Up to 6 months
  * Fine: Up to $2,500

#### **Related Charges:**

* **\[8] 1–3 – Drug Possession**
* **\[6] 1 – Driving Without a Valid License (if operating a vehicle)**
* **\[3] 1 – Resisting Arrest (Without Violence)**
