# \[8] 2 - Possession of a Controlled Substance (Class B - Moderate-Risk)

**Offense Classification:** **Misdemeanor / Felony**

#### **Definition:**

This charge applies to the **unlawful possession of less than 5 units** of a **Class B controlled substance**. These substances may be prescription-based or moderately addictive drugs.

#### **Examples of Class B Substances:**

* **Oxycodone / Vicodin**
* **Opium**
* **Adderall**
* **Xanax**
* **Lean (Codeine)**
* **Shrooms (non-psilocybin)**

#### **Elements of the Crime:**

* The individual **knowingly possessed** a Class B substance.
* The quantity was **under 25 units**.
* Possession was **unauthorized or obtained unlawfully**.

#### **Penalties:**

* **Misdemeanor (first offense):** Up to 1 year jail, $5,000 fine
* **Felony (repeat or aggravating):** Up to 3 years jail, $10,000 fine
