# \[8] 8 - Trafficking of Controlled Substances (Class B)

**Offense Classification:** **Felony**

#### **Definition:**

This applies when an individual possesses **25 or more units** of a Class C substance, and there are indicators of **distribution or illegal sale**, such as pre-packaged bags or scales.

#### **Examples of Class B Substances:**

* **Oxycodone / Vicodin**
* **Opium**
* **Adderall**
* **Xanax**
* **Lean (Codeine)**
* **Shrooms (non-psilocybin)**

#### **Penalties:**

* **Jail Time:** 2 to 5 years
* **Fine:** Up to $15,000
* **Loss of Diversion Eligibility**
* **Search Warrant Trigger for Vehicles or Properties**

#### **Related Charges:**

* **\[8] 9 – Trafficking of a Controlled Substance (Class C)**
* **\[8] 3 – Possession of a Controlled Substance (Class C)**
* **\[8] 11 – Possession of Drug Paraphernalia**
* **\[3] 6 – Obstruction of Justice** *(if distribution involved deception)*
