# MCC 1 – Refusal to Pay Fare

**Offense Classification:** Infraction / Misdemeanor (Repeat Offense)

**Definition:**\
Refusal to Pay Fare occurs when an individual engages and accepts transportation in a taxicab or other common carrier vehicle but willfully refuses to pay the proper charges at the conclusion of the trip.

**Elements of the Crime:**

* The individual accepted transportation in a common carrier.
* The individual knowingly refused to pay the lawful fare.
* The refusal was willful and unjustified.

**Penalties:**

* **Infraction (First Offense):**
  * Jail Time: 0 Months
  * Fine: $250 plus assessed fare
* **Misdemeanor (Repeat Offense):**
  * Jail Time: Up to 15 Months
  * Fine: $750 plus assessed fare
