# Expungement Request and Process

### **Introduction to Expungement**

All citizens within the State of San Andreas have the right to request an expungement of their criminal record under specific conditions. An expungement seals a criminal record from public access but does not erase it entirely. Law enforcement agencies, courts, and government entities may still access sealed records for investigative, licensing, or employment purposes.

Expungement is considered a privilege, not a right. The Department of Justice retains full discretion in approving or denying an expungement request.

### **Eligibility for Expungement**

Expungement is not available for all offenses. Certain serious crimes are ineligible, and an applicant must meet specific requirements before being considered. The following criteria apply:

* The applicant must not have any **pending criminal charges** at the time of application.
* The applicant must have **completed all sentencing requirements**, including probation or parole.
* Certain serious felonies, including but not limited to **Murder, Treason, Terrorism, and Racketeering**, **cannot be expunged**.
* Traffic citations are eligible to be sealed.

### **Expungement Application Process**

A **licensed attorney** must submit an expungement application on behalf of their client. The process is as follows:

1. **Letter to the Court** – The attorney submits a written request detailing why the expungement is being sought.
2. **Judicial Review** – A **District Judge** will assess whether the applicant qualifies for an interview.
3. **Expungement Interview** – If approved, the applicant, their attorney, and a **character reference** (employer, police officer, or medical professional) must attend an interview.
4. **Expungement Fee** – Payment of the **non-refundable** expungement fee:
   * **$5,000 for first expungement**
   * **$10,000 for second expungement**
   * **$25,000 for third expungement** *(There is no fourth expungement.)*

### **Expungement Program and Probationary Period**

For individuals granted an expungement interview, the judge may require participation in a **probationary period** before approving the request. During this time, the applicant:

* **Must not commit any new offenses**, including misdemeanors, felonies, or traffic violations.
* **Must provide proof of employment** at the time of application and throughout probation.
* **May be required to return for a final review hearing** at the judge’s discretion.

#### **Misdemeanor Expungements**

* **$500 per charge fee** payable to the Department of Justice.
* The applicant may apply **seven (7) days** after their most recent charge.
* If placed on probation, they must avoid any offenses for the entire **seven-day period** before final review.

#### **Felony Expungements**

* **$1,000 per charge fee** payable to the Department of Justice.
* The applicant may apply **ten (10) days** after their most recent charge.
* A **10-day probation period** is required before a final ruling.

### **Limits on Expungement Requests**

If an individual has multiple expungements, stricter requirements apply:

#### **Second Expungement Request**

* **Misdemeanors** – Application may be submitted **20 days** after the most recent charge.
* **Felonies** – Application may be submitted **20 days** after the most recent charge with a **10-day probationary period**.

#### **Third Expungement Request**

* Only granted at the discretion of the **Department of Justice**.
* **Misdemeanors** – Application may be submitted **one (1) month** after the most recent charge.
* **Felonies** – Application may be submitted **three (3) months** after the most recent charge with a **10-day probationary period**.
* **Any convictions for Attempted Murder or other Violent Felonies disqualify an individual from a third expungement.**

### **Support Programs for Expungement Applicants**

Several businesses and organizations provide support services to individuals seeking expungement. These groups help with employment opportunities and reintegration into society.
